PREP Students in Ethics Training for Securities Lawyers

In an effort to expand the reach of Miami Law's Professional Responsibility and Ethics Program, the students of PREP have taken on new and interesting areas of law, fundamentally intertwined with the Model Rules of Professional Conduct.

PREP students traveled recently to Bressler, Amery & Ross P.C., in Miramar, where intern Shayla Waldon and fellow Kelly Rains provided an interactive presentation on cutting-edge legal and ethical issues in the context of securities. The CLE presentation began with a discussion of conflict-of-interest issues that can arise when a firm undertakes the representation of multiple co-defendants in the same proceeding. The discussion then focused on how corporate counsel must identify who the "client" is within an organization so that the attorney-client privilege may be protected.

"This was a challenging assignment because conflict-of-interest issues are so complex and depend on the facts of each case," Rains said.

"I just learned about attorney-client privilege in my Professional Responsibility course, so I really enjoyed hearing the attorneys' experiences on how they work to protect the privilege," added Waldon.

The Professional Responsibility and Ethics Program, whose director is Jan Jacobowitz, was established in 1996 as an in-house program within the Center for Ethics and Public Service at the University of Miami School of Law. The program has dedicated countless student hours to public service and has educated thousands of members of the Florida bench and bar. As the students teach, they learn and often make a difference, prompting organizations to pause and reconsider their approaches to tough ethical dilemmas.
