The world-renowned authority on comparative law, European Union law, international trade contracts, WTO dispute resolution, and transnational litigation and arbitration, Professor George A. Bermann, will deliver the 2022 White & Case International Arbitration Lecture, "International Arbitration and EU Law: Still on a Collision Course?"
“The European Union has set out a serious challenge to existing mechanisms for resolving investor-state disputes, arguing that such disputes should be resolved in a permanent court rather than through arbitration. This is a significant issue for anyone interested in arbitration, in investment, or in institutions of international governance, and I cannot think of a better expert and scholar than Professor Bermann to address these issues,” says Professor Caroline M. Bradley, a Dean’s Distinguished Scholar and associate dean for International and Graduate Programs at Miami Law.
Although international arbitration and the European Union – two of the world's most robust international law regimes – have coexisted peacefully for decades, hostility between them has erupted, to the point that each of the two regimes regards the other as the prime threat to its authority. The contestation has been waged on several fronts and, while the termination of intra-EU bilateral investment agreements will mitigate them, mutual antagonism persists. How has this situation come about, and how can it be addressed?
Bermann is Gellhorn Professor of Law and Monnet Professor in European Union Law at Columbia Law School in New York and directs the Center for International Commercial and Investment Arbitration. He is an active arbitrator in both international commercial and investor-state disputes.
He is an expert on international litigation and arbitration and EU law before national courts and international arbitral tribunals. He is also the author of numerous books and articles on private international law and, most notably, international dispute resolution, including arbitration.
