Associate Professor Nikita Aggarwal recently published an article, “Locating Consumer Financial Regulation,” in Volume 46 of the Cardozo Law Review. The article expresses caution as fintech innovation progresses, with the Consumer Financial Protection Bureau considering personal data protection regulation as a framework for overseeing consumer fintech markets. The issue goes beyond the outdated rules for protecting personal data; it also relates to how thinking about personal data itself limits our ability to weigh the costs and benefits of data-driven innovations. This is becoming more important in a world filled with big data and advanced artificial intelligence systems.
