Fair Labor Standards Act overtime rule update

On Sept. 24, 2019, the U.S. Department of Labor published final rules that update the minimum salary levels needed for positions to be exempt from overtime pay. Effective Jan. 1, 2020, the Department of Labor rule increases the standard salary threshold from its current level of $23,660 annually ($455 weekly) to $35,568 annually ($684 weekly).  The Department of Labor’s salary level test is one of three tests that determines an employee’s exemption status from overtime pay.
